MINUTES OF THE MEETING OF THE LEE TOWNSHIP

PLANNING COMMISSION, WHICH TOOK PLACE ON TUESDAY,

MARCH 7, 2006,

LEE TOWNSHIP HALL, MIDLAND, MICHIGAN

 

 

PRESENT:  Commissioners –   Carol Alexander, Darla Rippee, Dale Wolfgang, and Tom York

ABSENT:  Toney Kerns

OTHERS PRESENT:   Dan Coe, and Tim Smith, Township Enforcement Officer

 

Mike Glynn called Jerry Davis, Building Inspector with the Township Code Authority, who had been invited by Mike to attend this meeting to discuss with the Commission the Property Maintenance Code.  Jerry informed Mike that he was still at work and would be unable to meet with the Commission tonight.  Mike will try again to schedule him.

 

The meeting was called to order at 7:05 p.m. by Chair, Tom York.

 

It was moved by Dale Wolfgang, seconded by Darla Rippee, that the minutes of the regular meeting of February 7, 2006, be approved as written.  Motion carried. 

 

CORRESPONDENCE:  None

 

Carol said she had called Donna Krips of McKenna Associates this afternoon for an update on the status of the proposed Lee Township Zoning Ordinance.  Carol was advised that Donna was out of the office, and Carol asked to speak with Daryl Fecha, who had been working with Donna on the Ordinance.  She was informed that he is no longer with McKenna Associates.  As of the time of the meeting, Donna had not returned the call.  Darla asked what we are going to do about our Ordinance if we haven’t heard from McKenna Associates by our April meeting.  Carol advised that she will continue to try to reach Donna Krips by phone, in the event her original call is not returned within a couple of days.

 

Dale said he had brought up to the Township Board at their meeting on March 6 that he felt the Township Board was derelict in its duty in collecting the fines imposed on the Frederickson’s by the court.  Dave Yost is going to check with the attorney with regard to attaching the fines to the Frederickson’s property taxes.  Dale said he suggested the fines be attached to the property at 106 South Eight Mile Road.  That way, if the Frederickson’s were unable to pay the taxes on that property, they could still have their home on the east side of Eight Mile Road. 

 

Tom mentioned that the fence on the property on the west side of the road is in violation, and nothing has been done with that issue.  Apparently the Township Code Authority has to handle that because it is a Building Code violation.  Tom said he had spoken with Mike Glynn about it several times, and Mike responds that he will talk with Jerry Davis.  That issue has been on the books for a long time with no action yet having taken place.

 

Dale said the Township has “lost its auditor, Dale Stanton,” who has taken a job in Saginaw.

 

ENFORCEMENT OFFICER’S REPORT:  Tim said complaints on a property on Bradford Road and the Noack farm on West Stewart Road are still pending.  He is working on a complaint at 944 West Olson Road, where a property is in foreclosure.  The lending institution informed him that they will have the place cleaned up within 30 days.

 

Tim said he received a complaint on property at 25 Shamrock Drive. He talked with the residents and they said they will have it cleaned up by April.

 

A complaint has just been made about 1717 Orus Road, and Tim will check it out.

 

With regard to Orus Road, Dale advised Tim that when a third house goes in on a road, the road must be brought up to County specifications, and the Code Authority should be inspecting it.  Tom read from the Township’s Ordinance, which says that a road which provides access to three or more residences must be designed to meet requirements of County road construction – road bed, ditching, width, etc., and must have a minimum right-of-way of 66 feet.  A building permit for the third house should not be issued by the Township Code Authority until the roadway is built to County standards.

 

Tim said he has a meeting tomorrow with Judge Donaghue to discuss ordinance enforcement in the Township.
